1. Introduction: A Paradigm Shift in Dutch Building Law On January 1, 2024, the Netherlands witnessed one of the most significant overhauls of its construction regulatory framework in a century. The Wet kwaliteitsborging voor het bouwen (Wkb) replaced the traditional system of municipal building permits ( omgevingsvergunning ) for low-risk construction projects with a private, risk-oriented quality assurance system. At the heart of this new system is the Kwaliteitsborger (Quality Assurer). kwaliteitsborgers
Unlike the old model—where municipal officials conducted cursory plan checks and occasional site visits—the Wkb places the primary responsibility for quality control on a certified, private, and independent entity. The Kwaliteitsborger does not build or design; they verify, monitor, and certify that a building project meets the essential requirements for safety, health, usability, energy efficiency, and environmental protection (the Bouwbesluit 2012 criteria, now part of the Besluit bouwwerken leefomgeving ). The central duty of a Kwaliteitsborger is to provide a Declaration of Conformity ( Verklaring van Gereedheid – Declaration of Readiness). Without this declaration, a new home or building (in the low-risk category) cannot be legally put into use.
